Terms of Service (TOS)

1. Purpose

FuryGamers is a portal providing access to a catalog of browser-based video games (HTML5), free to play without download. Some games are provided by third-party partner platforms (notably Playgama), while others are distributed under open-source licenses.

2. Minimum Age Requirement

Use of the Site, particularly the creation of a user account, is reserved for individuals aged 16 years or older, in accordance with the age of digital majority set by the GDPR and French law.

Users under 16 wishing to create an account must obtain prior and verifiable consent from a holder of parental authority. In the absence of such consent, UNIFYPIXELS reserves the right to suspend or delete the relevant account.

Access to the game catalog without account creation is not subject to any specific age restrictions, subject to the content of certain games that may not be suitable for a minor audience (see Article 7).

3. User Account

Creating an account allows users to save their progress, their favorite games, and access additional features (including the purchase of FuryCoins, see Article 5).

• The User agrees to provide accurate information during registration and to keep it updated.
• The User is responsible for the confidentiality of their login credentials and any activity carried out from their account.
• An account is strictly personal and cannot be assigned, shared, or transferred to a third party.
• UNIFYPIXELS reserves the right to suspend or delete any account in the event of non-compliance with these TOS, fraud, or misuse of the Site.
• The User may request the deletion of their account at any time by contacting: contact@furygamers.com.

4. Access and Free Service

Access to the game catalog is free and does not require account creation. The Site is financed by the advertisements displayed on its pages and through the optional sale of FuryCoins (see Article 5).

5. FuryCoins and Removal of Ads from the Site

UNIFYPIXELS reserves the right to offer, in the future, a virtual currency called "FuryCoins" allowing the purchase of a paid option to remove advertisements displayed on the FuryGamers Site (banners, ad placements, portal interstitials).

This feature is not activated at this time: no purchases, transactions, or payments are currently offered on the Site. FuryGamers is entirely free and funded by advertising.

If this feature were to be activated, the present TOS would be updated in advance to specify its terms (price, payment methods, exact scope, withdrawal conditions), and Users would be notified before any implementation. It is already specified that such an option, if activated, would not cover ads displayed within the games themselves, particularly those managed by third-party partner platforms (Playgama and others), which are the responsibility of the game publisher and/or the relevant distribution platform.

6. User Behavior

The User agrees not to:

• Disrupt or attempt to disrupt the technical functioning of the Site or the games offered.
• Circumvent, block, or alter the advertising or payment systems of the Site.
• Use automated means (bots, scripts) to access the Site or artificially generate game sessions.
• Fraudulently access an account other than their own.
• Use the Site for illegal purposes or contrary to these TOS.

Any failure to comply with these commitments may result in the suspension or deletion of the relevant account, without prejudice to any legal proceedings.

7. Game Content

The game catalog offered on FuryGamers covers various genres, some of which may include elements of stylized violence or intense competition. UNIFYPIXELS strives to select games suitable for a broad audience, but cannot guarantee that the entire catalog is appropriate for all ages.

It is the responsibility of parents and legal representatives to exercise appropriate oversight on the use of the Site by minors under their care.

8. Intellectual Property

The visual identity, logo, structure, and original content of the Site are the exclusive property of UNIFYPIXELS. The games offered remain the property of their respective authors, developers, or publishers, or are governed by their open-source licensing terms where applicable.

9. Liability

UNIFYPIXELS cannot be held responsible for the content, functionality, availability, or advertisements displayed by third-party partner platforms (notably Playgama), as these fall under the exclusive responsibility of those platforms.

UNIFYPIXELS cannot be held responsible for service interruptions, technical malfunctions, or data loss (game progress, FuryCoins) resulting from causes beyond its control.

10. Personal Data

The processing of personal data of Users is detailed in the Privacy Policy of the Site.

11. Modification of TOS

UNIFYPIXELS reserves the right to modify these TOS at any time. Users will be informed of substantial changes via a notification on the Site. Continued use of the Site following notification constitutes acceptance of the amended TOS.

12. Governing Law and Disputes

These TOS are governed by French law. In the event of a dispute, and failing an amicable resolution, French courts will have exclusive jurisdiction, subject to mandatory public provisions applicable to consumers.

In accordance with articles L.616-1 and R.616-1 of the Consumer Code, any consumer has the right to resort free of charge to a consumer mediator for the amicable resolution of a dispute opposing them to UNIFYPIXELS.
